KWADUKUZA LOCAL MUNICIPALITY MUST IMPOSE NUISANCE AND PUBLIC HEALTH BY-LAWS IN ZINKWAZI.

The Issue

Section 24 of the Constitution provides that everyone has the right to an environment that is not harmful to their health and wellbeing and to have the environment protected through reasonable legislative measures. To this end the Municipality must establish and enforce bylaws. These bylaws as established by the KwaDukuzu Local Municipality are currently not being enforced by the Municipality.

We the undersigned residents, homeowners and businesses in Ward 2 (Zinkwazi) of the KwaDukuzu Local Municipality now urge the municipality to impose Nuisance and Public Health Bylaws without any delay. The municipality needs to ensure that the residents’ rights to live in a peaceful and harmonious environment are upheld as stipulated in the constitution and in the Municipality’s own bylaws.

Here the following matters are of particular concern:

1.     The unacceptable loud noise and music that is played, which often carry-on until the early hours of the morning.

2.     Revving and spinning of motor vehicles in Black Rock Park and Nkwazi Drive.

3.     The public consumption of alcohol in Black Rock Park and the adjacent beach area.

4.     Littering of alcohol bottles (some broken), boxes, plastic and paper in Nkwazi Drive, Black Rock Park and adjacent beach area.

5.     No adherence to the opening and closure times to make use of the Black Rock Park facility, despite these times being clearly stipulated on the entrance board.

6.     No access control to the parking area of the park.

7.     The following periods are of great concern;

7.1  Every weekend from Friday until Sunday.

7.2  Public Holidays.

7.3  School holidays.

8.     Black Rock Park is not fenced. We would like to see fencing on THREE SIDES namely, Nkwazi Drive and northern and southern sides with the beach front open. An access vehicle gate that can be locked at 18H00 and an open pedestrian gate that gives access to the beach from Nkwazi Drive.

An urgent solution must be reached to solve the aforementioned problems, bylaw enforcements and also to appoint a consultant to investigate and advise the KwaDukuza council/municipality on how to deal with offenders/wrongdoers and force them to obey the bylaws of the municipality.
