1. And so this saga continues. The lawyers for the Body Corporate are telling me that I need to provide them with a list of documents that I would use in my defence in a trial. I am still waiting for that 'trial' to commence after six years of inaction. Trial...what trial I have asked them? No date has ever been set for a court hearing. I don't have to provide them with anything (they have all my documentation and correspondence anyway, including my two defence claims). It is they who have lodged a claim in the court...not me. They are the PLAINTIFF, I am the DEFENDANT

2.They are also asking me to seek quotes for a forensic accountant. I have told them on numerous occasions that the Body Corporate needs to be audited. I didn't say that I would be hiring a forensic accountant to commence an audit of the Body Corporate. Of course again, an audit needs to occur and at some point I hope that happens.This is how most lawyers work though. They twist what you say to suit their narrative. In short they LIE. How much would an audit cost? I don't know but I am surmising perhaps in the vicinity of $30,000...maybe more, depending on how much accounting fraud is uncovered? Do I have $30,000, $40,000, $50,000 to pay for an audit? Of course not.

3. In the meantime, I have told these lawyers to back off and stop their harassment of me. And no...I am not playing the victim. You see the previous law firm (the practice owner herself in particular) was doing the same thing to me three years ago. The current lawyer, who used to work for the first law firm has now been told to stop sending me unsolicited emails and letters to me as well, otherwise I will seek a restraining order against them. You see, why again I ask, do they not take their claim to the court? The answer is obvious. I keep telling them to take their claim to court. Happy to meet them there anytime.

4. I have also begun providing pertinent documentation to the committee. They have it on paper where they can see that ledger statements have been altered (at least three times as I state in my petition). I have also requested that they provide me with a list of all the lot owners in the complex. Any lot owner is entitled to that information. Ultimately I will be asking for and Extraordinary General Meeting to expose what has been going on here. None of this information is ever told to you. You have to find out all this on your own, or through others who have been through similar things. These are things that a lawyer that you hire should be able to advise you on. Nevermind.
