The Issue

Restore local control. No more state-mandated density without resident consent.

The Live Local Act (SB 102 and later amendments) lets developers put multifamily housing on commercial, industrial, and mixed-use land if 40% of units are labeled “affordable” at up to 120% of AMI for 30 years.

Then the city must approve it administratively. No rezoning. No Council vote. No required public hearing.

The law overrides local rules:

•  Density up to the highest allowed anywhere in the city

•  Height up to the tallest building within one mile

•  Floor area up to 150% of the highest allowed FAR

That is Tallahassee writing the site plan over the people who live here.

Why it is wrong

Florida’s Constitution gives cities home-rule power over planning and zoning. This Act strips it. Hillsborough County has sued. Other cities are preparing to. Forcing a tower next to homes with no vote is not local government. It is development without consent.

How it hits residents

•  Multi-story apartments next to single-family streets

•  More traffic on roads already jammed

•  Heavier load on schools, water, sewer, storm drains, police, and fire — paid by the same residents who cannot vote no

•  Neighborhood character changed for decades

“Affordable” at 120% AMI is not what most families think it means. 60% of the building can be market-rate. The shortcut is for the developer. The congestion stays with us.

We demand

1.  Repeal the Live Local Act.

2.  Restore city authority over height, density, use, and public hearings.

3.  Written neighborhood protections before any 20-year Comp Plan is locked in.

4.  Real notice to every affected household.

Housing matters. So does the right of a city to plan its own streets.

We do not consent. Abolish the Live Local Act.
