MEHRANGIR-DR.BHABHA’S HOME CASE
High Court has recorded the contents of the affidavit filed by the Central Govt. showing its inability to declare the structure as heritage since it is not more than 100 years old. When petitioner stated that now they have got some documents to show that the bungalow is in existence for more than 100 years, the high court has granted liberty to PS to make representation before the Central Govt. with documents to show that the structure is more than 100 years old.
2. High Court has also recorded the contents of affidavit filed by the State Govt. wherein it is stated that the Chairman of the Heritage committee has declined to declare the said structure as Heritage structure, that the State Govt. has directed the commissioner of BMC to look into the matter and thus, the proposal is pending with the State Government.
3. High Court has recorded that the purpose of the petitioners of filing PLI is served, since both the Central as well as State Government have been activated and the issue raised in the PLI is under consideration.
4. High Court has disposed of the PLI, since pendency of the petition is causing inconvenience to the NCPA and successful bidder in proceeding with the future process of bid.
