I’ve driven with Tesla Autopilot and Full Self-Driving since Navigate on Autopilot on my original Model 3 in 2017. I’ve stayed with it through every major release since then, and I’ve watched the software get calmer, more capable, and more trustworthy year after year. I still supervise the car. In my experience, that progress has made everyday driving safer and less stressful. I’m just one of nearly a million Tesla drivers in California — and California is Tesla’s largest U.S. market.

Here’s what frustrates me: even though I use that safer technology every day, I can’t get an insurance discount for it in California. Tesla Insurance offers FSD-linked savings in other states. Lemonade and other insurers also reward safer driving  — and in select states Lemonade even discounts Tesla FSD (Supervised) miles. California’s rules block those how-you-drive discounts here. Safer drivers like me subsidize riskier ones.

That is why I started this petition.

California is the only state that still blocks auto insurers from setting rates based on how people actually drive.

Everywhere else, safer drivers can get lower premiums. Here, they cannot. That includes people who use Full Self-Driving (Supervised) and other modern driver-assistance tools that cut crashes.

This is about fairness and road safety — for Tesla owners and for every driver who wants insurance that reflects real risk.

What we want

1. Let Californians opt in to privacy-protected, usage-based auto insurance.
2. Allow verified discounts for safer driving, including documented ADAS / FSD (Supervised) use, when insurers show clear actuarial evidence of lower claims.
3. Pass a successor to AB 311 (Consumer Driving Data Protection Act of 2026), which stalled in August 2026.
4. Keep Proposition 103’s consumer rate-review protections. No forced tracking. No selling driving data to brokers.

Why it matters

Company-reported Tesla FSD (Supervised) data from tesla.com/fsd/safety (captured Sept 15, 2026) shows FSD engaged had about 5.7 million miles between major collisions versus an estimated U.S. average of about 699,000 — roughly 8 times safer on that metric. Tesla also labels about 7 times fewer major and minor collisions versus its estimated U.S. average. FSD (Supervised) still requires an attentive driver. This petition is not asking for robotaxis. It asks California to let consenting drivers share in proven safety gains through lower insurance.
