تحاول وزارات الاتصالات اللبنانية المتعاقبة منذ عام 2012 مكافحة تهريب الهواتف الذكية، وذلك عبر إصدار كلّ وزير لقرار مختلف عن سلفه أو قرار مناقض له. وآخر هذه القرارات صدر عن وزير الاتصالات في حكومة تصريف الأعمال، جمال الجراح.

يحمّل القرار رقم 227 / 1 أعباء إضافية للمواطنين بدءاً من 3 أيلول 2018، إذ بات على كلّ المستخدمين التأكّد بأنفسهم من مطابقة أجهزتهم الخليوية "للمواصفات الفنية العالمية المحددة من قبل GSMA، والتأكد من أنّ الأجهزة أصلية". كما فرض القرار دفع رسوم جمركية للهاتف حتى لو كان للاستخدام الشخصي.

وبهذا تحمّل الوزارة المواطنين مسؤولية تهريب الهواتف وتكاليف الرسوم الجمركية، بدلاً من مكافحة التهريب من مصدره الأساسي!

والموقع الذي خصصته وزارة الاتصالات للتحقّق من رقم IMEI غير آمن (يعمل وفق نطاق http وليس https الأكثر أمناً)، ناهيك عن أنّ الموقع الرسمي لوزارة الاتصالات ليس آمناً أيضاً.

نرى أنّه لا ينبغي أن يتحمّل المواطنون أعباء إضافية على استخدام هواتفهم، خصوصاً وأنّ أسعار الاتصالات في لبنان تُعتبر من الأغلى عالمياً. لذلك نطالب بما يلي:

- مراجعة وزير الاتصالات لهذا القرار وعمل الحكومة على مكافحة التهريب من مصدره بدلاً من تحميل المسؤولية للمواطنين.

-عدم تحميل المواطنين تكاليف إضافية، خصوصاً للمسافرين الذين يعودون مع هواتفهم التي اشتروها من الخارج للاستخدام الشخصي.

-إلغاء الحاجة إلى التأكّد من مطابقة IMEI على موقع غير آمن أصلاً، وتحديث الموقع الإلكتروني الرسمي لوزارة الاتصالات واعتماد معايير أكثر أمناً.

Since 2012, the Lebanese Ministry of Telecommunications – under its changing leadership – has attempted to combat the smuggling of smartphones. This initiative has been taken by each minister, who’s either issued a different directive from his predecessor or one that contradicts it, the latest of these made by the caretaker minister, Jamal Jarrah.

Resolution No. 227/1 carries additional burdens for citizens as of September 3, 2018. All users must ensure that their mobile devices comply with "the GSMA's international technical standards and [they also must] ensure that the devices are genuine.” They will moreover be charged customs for any person’s non-local phone even if it is for personal use.

Through this decree, the ministry has held citizens responsible for the smuggling of telephones and the cost of customs, instead of combating smuggling from its source!

The website assigned by the Ministry of Telecommunications to verify phones’ IMEI number is not secure (running on http, not the more secure https) in the same way that the ministry’s website isn’t.

We stand by our belief that citizens should not be additionally burdened for their phone use, especially since telecommunications prices in Lebanon are among the most expensive in the world. We therefore demand that:

The Ministry of Telecommunications review and amend the directive, and the government to  combat smuggling from its source rather than placing the blame on citizens.
The ministry immediately must cancel custom charges on citizens, especially for travelers who return with their phones bought from abroad for personal use.
The ministry eliminate the need to check phone IMEI on an unsafe website, update the Ministry's official website and adopt more secure standards.
