Let us know what are our rights if we get apprehended because of Memorandum Circular No. AVT-2015-1927 and dealers informs us that our OR/CR/plate has not been released yet by LTO before 1st of April 2015?

The Issue

 

To whom it may concern, 

 

We, the riding community of the Philippines - both car and motorcycle owners and future buyers (and I suppose even the car and motorcycle dealers) - are in panic and have a lot of questions regarding the recently released Memorandum Circular No. AVT-2015-1927 (as seen here: http://on.fb.me/19p6VLt ). As such, we would like to know our rights and have more information and clarification as to what we can expect from LTO regarding the following: 

  • > In case we get apprehended, somewhere between April 1st 2015 onwards, because of the Memorandum Circular No. AVT-2015-1927 for having neither OR/CR nor our plate when the dealer / manufacturer where we bought our car/motorcycle from informs us that the said OR/CR or plate has not been released yet to them by LTO before April 1st 2015 - Are we supposed to pay the fine of either P5,000 (in the absence of OR/CR) or P11,000 (P10,000 in the absence of plate + P1,000 for reckless driving) plus the motorcycle being impounded if it's already past 37 days from the date of purchase - when it's clearly not our fault if the dealer informs us that they don't have these yet as LTO haven't released this to them too? What do we do? ;

  • > The average time it takes motorists to receive their OR/CR from their dealer ranges from 3 months to a year and even more for some, while plates takes an average of a year or more, and sadly by the time we receive the plate, the sticker or registration has already expired, thus causing us to pay again for registration/stickers ( See this survey for reference, and this is just for motorcycles, shall we get a survey for cars too? http://on.fb.me/1NlfRPm) As such, what do we - the Filipino riding and tax paying consumers - have to do if an officer insists to give us a ticket with the above fines? Where do we file a complaint if it's not our fault that our dealer hasn't provided us with these yet? Should we file a complaint to the Department of Trade and Industry against our dealer? or against LTO? Or do we really have to resort to reporting cases like this to the media to get a faster response as what we can see in this video from ABSCBN's Kulang Sa Pansin / Tapat Na Po episode: http://on.fb.me/193on8z ;;

  • > We would like to get some clarification as well, does this memorandum apply only to 4-wheeled vehicles (as stated on the first paragraph) - or - to any vehicle (as stated on item number 1 on the memorandum) as this is confusing and obviously a clear loophole that some officers can abuse just to get someone apprehended. 

We will be awaiting for your soonest response and advise on this matter as we all know this will definitely impact the number of people buying cars and motorcycles from this day onwards as well.
