PETISYEN UNTUK MEMPERKUKUHKAN KEDAULATAN UNDANG-UNDANG DENGAN MEMISAHKAN PERANAN PENDAKWA RAYA DARIPADA PEGUAM NEGARA

Kami menggesa Perdana Menteri Dato’ Sri Ismail Sabri Yaakob dan semua Ahli-Ahli Parlimen untuk memperkukuhkan kedaulatan undang-undang dengan memisahkan peranan Pendakwa Raya daripada Peguam Negara sebelum PRU15!

1. Peguam Negara yang dilantik oleh Yang di-Pertuan Agong (YDPA) adalah berdasarkan nasihat PM untuk menjadi penasihat undang-undang kepada YDPA, PM dan Kabinet, merupakan satu lantikan politik. 
2. Peguam Negara sekarang juga merupakan Pendakwa Raya dan mempunyai kuasa dibawa budi bicara beliau untuk menjalankan atau menghentikan sebarang perbicaraan bagi sesuatu kesalahan. 
3. Hal ini merupakan suatu konflik kepentingan dan telah menyebabkan banyak tuduhan campur tangan politik melalui pendakwaan terpilih dan imuniti, tidak meneruskan pendakwaan yang sedang berjalan dan penarikan pendakwaan terhadap mereka yang di pihak kerajaan. 
4. Peranan Pendakwa Raya perlu diasingkan dan dilantik oleh YDPA melalui proses yang telus dan bebas daripada pengaruh PM.
5. Peguam Negara perlu kekal dilantik atas nasihat PM untuk menjadi penasihat kerajaan dan tidak berperanan dalam proses kehakiman. 
6. Kedaulatan undang-undang adalah salah satu Rukunegara dan prinsip pemisaha kuasa antara Eksekutif, Kehakiman dan Legislatif perlu dipertahankan setiap masa. 

Kami rakyat Malaysia menolak sebarang parti politik yang tidak berazam untuk atau mempertahankan kedaulatan undang-undang dalam negara ini. Kami tidak mahu keadilan dua darjat di mana yang kaya dan berkuasa meloloskan diri daripada keadilan manakala rakyat biasa diharap untuk menjadi warga yang patuh undang-undang atau akan berhadapan dengan hukuman.

PETITION TO STRENGTHEN THE RULE OF LAW BY SEPARATING THE ROLE OF THE PUBLIC PROSECUTOR FROM THAT OF THE ATTORNEY GENERAL

We call on the Prime Minister Dato'Sri Ismail Sabri Yaakob and all Members of Parliament to strengthen the rule of law by separating the role of the Public Prosecutor (PP) from that of the Attorney-General (AG) before the 15th General Election is called.

1. The Attorney General is appointed by the Yang Di-Pertuan Agong (YDPA) on the advise of the PM to be the legal advisor to the YDPA, the PM and the Cabinet, and is a political appointee. 
2. Currently the AG is also the PP and have the power, exercisable at his discretion, to institute, conduct or discontinue any proceedings for an offence. 
3. This a conflict of interest and has led to allegations of political interference through selective prosecution and immunity, non-pursuance of existing charges and withdrawal of charges for those aligned with the government.
4. The role of the Public Prosecutor must be a separate person who is independently appointed by the YDPA through a transparent process free from the influence of the PM.
5. The AG should remain to be appointed on the advice of the PM to be the government's legal advisor and have no role in any judicial processes.
6. The rule of law is part of our Rukunegara and the principle of the separation of power between the Executive, Judiciary and Legislature must be upheld at all times.

We, the Rakyat, will reject any political parties that do not commit to or uphold the rule of law in this country. We do not want "double standard justice" where the rich and powerful can escape justice while the rest of us are expected to be law-abiding citizens or face punishment.
