Stop the $9 Billion Dollar Kohler Company from Bullying a Local Small Business

The Issue

Kohler Company has sued me!  They claim they have the exclusive use of the word "Whistling" and want me to change my business name. There are over 70 businesses in the United States that use this word in their business name such as "Whistling Wings, Whistling Creek and Whistling Dixie."  My business has been registered both federally, in the state of Wisconsin and locally in the Town of Sheboygan as Whistling Oak Apartments LLC.  It is a new development of affordable apartment homes in the Town of Sheboygan located in the state of Wisconsin. 

The name was selected because the new development is in a "wind tunnel" and there is a great, perhaps 200 year old, OAK TREE on the property that "whistles in the wind."  I have 8 employees and we did a naming contest with the winner getting a $100 gift card for the best name. 

The project went thru the first phase of approvals by the Town of Sheboygan in open public meetings that started in the fall of 2019.  The public has been aware of this project since then thru additional Town of Sheboygan public meetings, press releases, newspaper articles, the Chamber of Commerce and more.  Kohler company had plenty of time to object to the name choice.  Now I am heavily invested into the name which will cost $10s of thousands to change or I have to invest in attorneys which potentially will cost even more.  Although this amount of money in inconsequential to Kohler it is huge to our business!  

How am I going to be able to fight a 9 billion dollar company that has a 100 times more attorney's than I have employees?   CONSUMER OPINION IS HOW!  I need your help in raising awareness of this bullying large corporation picking on a small business with a ridiculous request...change the name of your business!  Tell Kohler Company to leave our business name alone.  Can I count on your social media support?  Please support my small business of Whistling Oak Apartments LLC.
