Secure the right of UOC believers in Kinakhovtsy to use their temple

The Issue

On March 5, representatives of the “Right Sector” and the "initiative group" of Kinakhovtsy village, Zbarazh district, Ternopol region, undertook another attempt to take over the UOC temple.

“The security company from Kiev we had invited beforehand and the parishioners who have kept round-the-clock vigil in the temple, precluded the schismatics from the shrine takeover,” recounts senior priest Vitaly Guriev. “ But the KP adherents report they intend to pursue their seizure attempts and now they will choose to do in a "lawful" way and re-register the community’s charter.”

On the eve, March 4, radicals initiated another “referendum” on the temple transfer to the jurisdiction of the UOC KP during which 68 of 223 parishioners were interviewed. The first such meeting was held on February 23, and then 59 persons took part in the initiative, many of whom are not based in the village. At that, people who want to join Kiev Patriarchate said that they have no claims on the temple but strive for changing the parish charter instead.

Schismatics claim that they've registered a new charter (as of an UOC KP parish), however, up to now an existing charter (as of UOC parish) is still in force legally since there was no decision about its denounciation.

The UOC community of Kinakhovtsy village made an official address to the local, regional and law enforcement authorities with a demand to protect their rights. However, Zbarazh district police department hadn't even included their statement into the Unified Register of pre-trial investigations until the Zbarazh District Court sustained the claim over inactivity of local law enforcement authorities (see decision on case № 598/459/17 dated April 10).

St. Peter and Paul church is the only UOC temple for several villages in the district. At the same time there are already some temples of the Kiev Patriarchate within a walking distance.

On May 5 there was organized a round table in Vishnevets town, Zbarazh district, which brought forward an issue of preserving the community of the Ukrainian Orthodox Church being subordinated to the local town council in Kinakhovtsy village.

According to the protopriest of St. Apostles Peter and Paul temple father Bitaliy Gurev, representatives of the local power literally delivered an ultimatum to the present functionaries from Ternopol Regional State Administration, demanding to fulfill wishes of the KP adherents. By the priest’s accounts, the Administration is likely not to hurry up with the UOC statute’s re-registration due to the criminal proceeding having been initiated upon the actions of the KP activists.

On May 14 in Kinakhovtsy village, Zbarazh district, Ternopol region, the UOC KP adherents took on open threats towards the community’s headman of the Ukrainian Orthodox Church.

Senior priest of the local temple of Saint Apostles Peter and Paul Vitaliy Gurev reported that on this day nearly 20 persons – so called initiative group on “transition” of the community to the Kiev Patriarchate – arrived at the house of the UOC headman Stepan Tivoniak. The unwanted guests demanded that the man give them the temple keys for them “to hold a prayer service” and beat him. The UOC community qualifies the recent behavior of their fellow villagers as a provocation. Upon the arrival of the “initiative group” the headman called the police.

By the priest’s accounts, on previous Sundays during worship services of the UOC community, nobody barred the members of the Kiev Patriarchate from coming to the temple and pray there.

However, on May 15 the supporters of the Kiev Patriarchate willfully broke the door and entered the church. UOC believers attend divine services in their priest's house. And their attendance rate is far more higher than of those adherent to the Kiev Patriarchate who seized the shrine. Law enforcement authorities have started investigation on beating of the headman, but hadn't include the statement on seizure of the temple into the Unified Register of pre-trial investigations yet.
