Stiffer penalties for people who make false abuse allegations

The Issue

 

 

 Hi my name is Elaine Arnett. I am a proud mother of three beautiful daughters and a grandmother to four beautiful children. Three boys and one girl. I love them all unconditionally. It hurts me to see them being hurt so badly and senselessly. It is sad thing when parents, guardians, or just people in general report false allegations of abuse to Child Protective Services (CPS) in hopes to try to gain something from it. For example a parent don’t want to pay child support, or a person wants to emotionally harm another person by hurting their children, etc. the list goes on. Unfortunately, this happens all the time. And way too often in fact without consequence to person making up the lies. Below is some of what has happened to one of my daughters. Please help me stop this.

My name is Erica LeAnn Arnett. I am a single mother of three children, two boys ages 8 and 6, and a little girl who is 3, soon to be 4. Since September 2011 I have been going through a custody battle over my little girl. When all this began she was 1 ½ years old. Except for a few months of her life when her father and I were in relationship, he didn’t have anything to do with her. He never helped me provide for her with things a growing child needed no matter how many times I asked. I even begged. I finally filed for child support in July of 2011. For a straight week her father kept asking me to drop support because he needed to pay bills, needed money to live on, etc. the excuses kept coming. His child support was only $210 a month. I refused to drop it so next thing I know I am hit with him filing for custody and things have been crazy since. This past year he was awarded supervised overnight visit at his parents’ house with them being the supervisors for one night a week. February 2012 Child Protective Services (CPS) came to my home. There was several reports, one being I endangered my child by a gun and the other two reports were of sexual abuse. While CPS was investigating these allegations, my girl’s father was at the judge’s office trying to get custody of our daughter with a signed affidavit saying I have several men in and out of mine home, they sleep with my little girl, they bath her, and they change her diaper. The judge called the CPS worker while she was at my home to see what she had found out. She thoroughly investigated everything and the charges were unfounded. My boys were scared they were going to be taken because all the questions she had asked them. It took them a little while to get over it. On February 5, 2014, I received a call from a state trooper. This was an hour before I was to pick up my girl from her father’s. He informed me that I would not be getting my daughter back. My little girl’s father called him and CPS and reported that she was being sexually abused by my two sons. My heart dropped and I just bawled. CPS has been to the home and has found nothing. All doctor reports and records show nothing has been found. Her father filed a Extra Protection Order (EPO) against me saying that I knew about the alleged sexual abuse so I was not allowed to talk to, or see my little girl at all. We went to court for the EPO in his town on February 14, 2014. The judge transferred everything over to the county I live in because this is where all the court proceedings have been at and this judge knows the case. Her father’s girlfriend didn’t want me to see my little girl at all but the judge gave me two hours of visitation supervised once a week at CPS. First time I got see my little girl in three weeks since all this was today, Feb. 26, 2014, a week and half after I was granted visitation. She was so happy to see me. We both cried and hugged and kissed each other for over fifteen minutes. We played some. Then she cried and begged to come home and that broke my heart even more. I just told her she couldn’t but I promised she would be home soon. I have never been as upset as I was today when she was begging to come home but I had to tell her she couldn’t. This has not only affected her and me but my two boys as well. My oldest is the one they are trying to pin this on the most. He was crying thinking he was going to jail and wanted to know why people were saying he hurt his sissy, that he loved his sissy. I have never seen two kids as close as my little girl and my oldest son. He has taught her to read, count, her colors. He plays dolls with her. I can’t even hardly describe how close they are. My little girl always had to kiss her brothers good night before she would go to bed. My boys did not do these things to their sister but they are being punished for it. I am told the only way I can get my daughter back is to put my boys in counseling, for something they did not do. And CPS told me I needed intensive parenting classes for two weeks here at my home because I didn’t supervise my children enough. CPS has all this evidence to show nothing happened but yet my family has go through all this and it could take at least six months before I get my little back. Her fourth birthday is coming up soon on the 29th of March and none us will get to celebrate it with her.

 

Please sign this petition so others won’t have to go through what I and my children are going through. If anyone needs to be punished or charged with any type of abuse, it is people who put their children through this. It is selfish love, not selfless. It is emotional abuse. It is mental abuse. It is physical abuse. No child should have to go through all these grueling exams when all the evidence already shows nothing happened. Please help me stop this and get harsher punishments.
