Canadian Disabled Veterans Deserve GOOD Appeal Rights
The Issue
Veterans Affairs Canada's primary benefit under the New Veterans Charter is the Earnings Loss Benefit.
This flagship benefit has woefully, perhaps unlawfully, lacking APPEAL Rights.
It has only two levels of internal review with no EXTERNAL review. Not even to the Veterans Review & Appeal Board.
Another huge problem is that, should the review be approved, the date of approval is the date of the review approval!
Let me put it in bald terms:
Veterans Affairs Canada can deny the claim on any grounds. The veteran asks for review. Time passes (say 6 months).
Veterans Affairs Canada denies again. The veteran asks for the final review. Time passes (say 6 months). The Review is approved.
The Veteran is deprived of the time value of the money. Veterans Affairs Canada keeps the time value of the money as well as the principal.
Let us assume, rightly so, that the veteran finds this GROSSLY UNFAIR in a democracy & he wishes to appeal to an independent arbiter.
There is no RIGHT!
The Disability Award, a much less valuable Right also has full appeal Rights, akin to the Pension Act pension.
Can Vet can appeal to the Veterans Review And Board? NO.
A recent Supreme Court of Canada case, in 2014, said this kind of act directly challenges the RULE OF LAW!
We need to get this changed if we want to keep our DEMOCRATIC Rights.
Our Rights are being nickle & dimed though this is such an obvious injustice I cannot understand why no one has not brought this up before.
Where are the Canadian Forces & Veterans Affairs Ombudsmen while this travesty occurs?
