We are putting up this petition so that us at Elixir Music House may continue to do the things we have done and the venue space has done for the last 12 years.

As you may be aware, Elixir Music House has had some trouble from a nearby neighbour since April 2021. His relentless harassment has seen us tied in red tape, too many hours spent defending and proving our compliance, writing 10-180 page documents to satisfy departments, having licencing, council, EPA, and Body Corporate Commission all continually visiting or contacting us. His harassment started from our "unsightly" unused equipment in our car ports and the fact we used to allow a couple of homeless guys to stay there. This guy doesn't even live here! He resides in Melbourne and is only here through school holidays. These actions and harassment is no way inclusive or contributive to the Cairns Community. His actions, we feel, are actively trying to shut us down and, as the only independent live music and creatives outlet in Cairns, this is hearbreaking for many and tears my soul. 

Elixir Music House are asking community support of the following:
- Our MCU {Material Change of Use} to be approved by Cairns Council so we can continue to operate and do what we we've always done
- Acknowledge our venue has been a music establishment for over 12 years - For all departments to recognise this situation is pure harassment. It is also personal {he had a physical encounter with my partner in Sept last year} 
- For QLD and Cairns Council to start a conversation and the process of creating a reform similar to what NSW has just started, which includes:
* Order of occupancy- new comers can not shut down or cut back existing venue operations
* Sensible sound management - for our DB limits and readings to align with the EPA Legislation {specifically for ours to be changed to read as new ones are, from OUTSIDE the venue}
* Vibrance {for us to have the ability to paint and have signage without Body Corporate approval as it will always be knocked back by him}
* Noise complaints- a single complaint can no longer be able to shut down or harass a venue

They are an essential part of our community in Cairns and integral to the development of emerging artists.

Their contribution to the community through holding space for expression and activities is also unrivalled in Cairns, and all off the backs of Sky and Bill, their trusty and loyal crew and volunteers, musicians and creatives and of course the punters, customers and contractors. 

Our community is their driving force to keep going and keep vibin'.
