"In the Auckland High Court today (Friday 29 November, 2024) the Barrister for Gulf Harbour Country Club 2016 Ltd (GHCC 2016) asked the Court to adjourn the hearing brought by KWGS to liquidate GHCC 2016.
The barrister stated that it was the intention of GHCC 2016 to seek a compromise with creditors and needed time to set this process in motion.
He advised that total GHCC 2016 debt was over $400,000. Of this $20,000 is owed to IRD.
KWGS's barrister objected to the adjournment but the court granted it.
The hearing was adjourned to 02 February 2025.
The court did require GHCC 2016 to present all necessary documentation required to commence a creditor compromise process to the court by 20 December.
The barrister also indicated that attempts were underway to raise funds to pay all debts.
We have heard promises like this on many occasions and nothing has ever come of them.
KWGS is of the view that this adjournment is a delaying tactic as we have seen employed previously."
