Keep Whangaparāoa’s Green Spaces (KWGS) files to place GHCC 2016 Ltd in Liquidation

A notice to liquidate Gulf Harbour Country Club 2016 Limited (GHCC 2016 Ltd) has been posted in the New Zealand Gazette by KWGS. The liquidation hearing date is 29 November at 10.45 am at the Auckland High Court. The options for GHCC 2016 Ltd are to pay the debt claimed, contest the debt or do nothing.

If the debt is paid (approximately $50,000) then the matter is closed and any further claims would need to be brought through a new proceeding.

There is little prospect that the debt can be contested as the debt is an aggregation of GHCC Member claims for fee reimbursement that have all been the subject of Disputes Tribunal decisions in favour of the individual members.

If GHCC 2016 does not respond to the claim, the matter will still proceed on the hearing date and the Judge will declare GHCC 2016 Limited is in liquidation and a liquidator will be appointed.

Once a liquidator has been appointed other creditors such as former employees and GHCC members who have not proved their debt through the Disputes Tribunal can apply to the liquidator for payment of their claims.
