The Issue

PETITION FOR A REDRESS OF GRIEVANCES

FROM THE INHABITANTS OF DESCHUTES COUNTY, OREGON

We the inhabitants of Deschutes County, Oregon come before this elected governmental body, in whole and in part, to present a formal redress of grievances.

It is the Right of the people to peacefully assemble, to consult for our common good, to advise our representatives, and to petition our government freely, without impediment or restriction.

We, the undersigned residents of this County:

1.       State to this body, the right of the people to be treated equally under the color of law has been violated. Article 1, section 20 of the Oregon constitution states, “No law shall be passed granting to any citizen or class of citizens privileges, or immunities, which, upon the same terms, shall not equally belong to all citizens.”  This body has allowed a certain  class of citizens immunity from the law, arbitrarily declaring certain citizens essential, and others non essential, creating different laws for one class, not equally applied to the other.

2.       This governing body has allowed a civil employee of this County to use threats, force or intimidation to coerce the inhabitants to comply with orders contrary to the Rights protected in our constitution.  District Attorney John Hummel has publicly called for citations and arrests of those who do not comply with the quarantine orders issued by the State.  Article 1, Section 26 of the Oregon constitution again states, “No law shall be passed restraining any of the inhabitants of the State from assembling together in a peaceable manner to consult for their common good; nor from instructing their Representatives; nor from applying to the Legislature for redress of grievances”

3.       This governing body has failed to protect the rights of the individual, the first inherent duty of a republican form of government.  This body has refused to interpose on our behalf in the protection of life, liberty and property from another governing body that has broken down the function of a representative form of government.  The People in a Republic demand representation at all times, especially in times of danger and duress. This State has clearly failed to uphold the lawfully duty as described again in the Oregon constitution, article X-A, describing the duties of the Governor after a declaration of emergency.  The Governor’s duty is to convene the legislature, so that We the People have a proper representation and voice in the matters concerning our lives and this State.

4.       This governing body has failed to interpose on the impediment of the State of Oregon upon the People’s life, liberty, and property.  This State has unlawfully impeded upon the free travel of the inhabitants, the free use of private property, the free use of publicly owned property, and restricted the ability of an unlawfully deemed class of citizens “non essential”, the ability to provide for themselves and family, under the guise of public safety, under the threat of force, coercion and intimidation.

5.       This governing body has failed to interpose when the State has again through threat, force, coercion and intimidation, closed our places of worship, denying the people yet another right of the People, enumerated time and again in both the State and Federal Constitutions.

6.       This governing body has allowed our County to be deceived by the State.  This State of Oregon has made false promises, and has not upheld its end of the bargain.  Citizens stayed home under the premise that help would be equally available.  We see time and again that equal application and protection is not a priority of this State.  Some have received help, while the vast majority are left to suffer financially.  Businesses that remain open and functioning receive grants, while those forced to close receive nothing.  Minimum wage workers making $200 a week have received $800 in unemployment benefits weekly, while many are unable to even file due to the ineptness and failures of the State of Oregon unemployment system.

We, the undersigned inhabitants of this County serve this redress upon you, the elected commissioners of Deschutes County, Oregon.  We formally compel you to act on our behalf, publicly addressing and correcting the issues presented above.  Our Rights are non negotiable, active and applicable at all times, even in times of distress. They must be protected by the bodies elected to represent, and by each individual without fail. Equal application of rule and law must never be allowed to be compromised.

We compel you to act on our behalf, no longer recognizing the State’s unconstitutional stay at home orders, effectively reopening our businesses and communities.
