Kada’s Law – Justice That Cannot Be Silenced

Purpose:
To ensure that cases of abuse, stalking, and kidnapping are prosecuted based on clear and verifiable evidence, even when victims or witnesses cannot appear due to fear or trauma — and to close the bail loophole that allows dangerous offenders to walk free before full judicial review.

• Evidence-Based Prosecution: Allows prosecutors to proceed on strong digital, physical, or testimonial evidence even without direct victim testimony.
• Mandatory Judicial Review of Bail: Requires judges to conduct a full evidence review and issue a written safety finding before bail is granted.
• Prosecutor’s Right to Appeal: Empowers District Attorneys to appeal unsafe bail decisions to a higher court without delay (to hold the accused until the case is properly reviewed by the Judge, not in haste).
• Victim Protection: Prevents victims from being penalized or forced to testify when trauma prevents participation.
• Training Requirements: Establishes trauma-informed training for all law enforcement, judicial, and prosecutorial staff.

Kada’s Law was inspired by the tragic case of Kada Scott, a young woman kidnapped by a repeat offender who should have been incarcerated years prior. Her story represents countless others whose voices were lost to fear, and whose justice was delayed by inaction.
