Stop Set Offs: Support PEOPLE not COMPANIES
The Issue
Many companies place SET OFF clauses in their policies of insurance or pensions.
Workers' Compensation laws across Canada prohibit anyone from taking that money into account, in law, by placing a phrase like this, or words to that effect, into the law:
No one can claim a set off against this benefit.
It is time for Canada to clarify the various Federal Benefits with the addition of a similar provision! That would require amending the following Acts to place an equivalent section into law:
Canadian Forces Superannuation Act s. 83
RCMP Superannuation Act
Public Service Superannuation Act s. 10(10)
Canada Pension Plan Act s. 65(1)
Old Age Security Act s. 36
Employment Insurance Act s. 42
New Veterans Charter s. 89
Pension Act s. 30(1)
Only by doing this can the disabled in Canada achieve justice. Canada has specific & general laws to prohibit this BUT the companies are using a loophole in that it is not expressly prohibited!
That is probably not necessary as the laws stated above are specific prohibitions against interception of a Crown debt. There is also a general prohibition against intercepting a Crown debt: FAA s. 67.
However, these companies are IGNORING these laws. Canada is looking the other way as they are saving money at the expense of the disabled.
There is a word for that: DISCRIMINATION
Charter s. 15(1) is supposed to prohibit this BUT it is more convenient to ignore the Charter when it costs money, it seems.
It is time to clarify the law. An OMNIBUS Bill is a good choice.
