3/18/15 Update - At yesterday's sentencing, Justice Kimberly van Haaster found 3 years of probation and no jail to be appropriate punishment.

UPDATE: SENTENCING ADJOURNED FOR MARCH 17TH AT 12:30PM, 41 WEBSTER AVENUE, GOSHEN NY
PETITION: JUSTICE FOR DAISY
On May 19, 2014, a landscaper named Jay Testa, of Joe Mehl Landscaping, ran over our dog, Daisy with a lawnmower, which sliced her paw off. Without providing any assistance or calling for any help, Jay left Daisy to die in our backyard. Daisy's leg was so badly damaged, that it had to be amputated at the shoulder. The District Attorney charged him with violating the NY Animal Cruelty statute – New York State Agricultural Law § 353 – which carries a penalty of up to 1 year in prison.
Jay pled guilty on December 9th, 2014. However, the judge indicated that because this is his first offense, he should get NO JAIL TIME and only probation! We find this appalling and disheartening. It sets a dangerous precedent of leniency for first time criminals who commit similar callous, depraved acts, and does little to deter animal cruelty.
Sentencing is open to the public on February 17, 2015, at 12:30pm at Goshen Town Court located at 41 Webster Avenue in Goshen, NY. If you agree that Jay Testa should see some jail time for cutting off Daisy's paw, and leaving her to die, please sign this petition. We will likely have a chance to address the court and let them know why Jay Testa belongs behind bars. We would like to present the signatures on this petition to the court to show that society supports jail time for Animal Cruelty.
