A Child Suffered a Devastating Brain Injury. We Demand Answers, Accountability, and Immediate Action.
We are calling on Mercy Gilbert Medical Center and Aryan Toosi, D.O. to answer for the care of our son, Vincent Fiordilino. Vincent suffered a severe hypoxic brain injury and will require extensive lifelong care. Our family deserves answers about how this happened, why it happened, and what will be done to prevent another child from suffering the same fate.
Dr. Toosi pronounced Vincent dead without ever taking his temperature and before critical laboratory results were available, yet told us and later documented those results as part of the basis for his decision. According to the records, those results did not become available until 18 minutes after Vincent was pronounced dead.
More than five hours later, Vincent was found alive in the hospital morgue by a medical transporter, moving and gasping for air. The prolonged absence of medical care, treatment, and monitoring caused Vincent’s devastating brain injury.
How could a child be pronounced dead and then found alive hours later inside the hospital? How were critical test results handled? Why was Vincent left without medical care for so long? And what responsibility do the physician and the hospital bear for the decisions and failures surrounding these events?
We Demand Immediate Action from Both the Hospital and the Physician.
We call on Mercy Gilbert Medical Center and the appropriate oversight authorities to:
- Remove Dr. Toosi from patient care immediately while these serious concerns are independently investigated, and take decisive employment action, including termination of his employment.
- Hold Mercy Gilbert Medical Center accountable for its role in Vincent’s care, its response to these events, and its responsibility to protect patients.
- Conduct a thorough, independent investigation into the decision to pronounce Vincent dead, the timing and interpretation of laboratory results, the concerns surrounding temperature correction, and the events that followed.
- Provide our family with clear answers and appropriate access to investigation findings.
- Explain what went wrong and who was responsible, and identify the corrective actions necessary to prevent similar failures.
- Protect other children and patients by taking meaningful, verifiable steps to address any deficiencies identified.
Why Have We Not Received the Answers We Deserve?
Why is Dr. Toosi still treating patients? Why was he not placed on leave while these grave concerns are investigated? What did Mercy Gilbert Medical Center know, when did it know it, and what action did it take? What safeguards failed, and what is the hospital doing now to ensure other children are safe?
Both Dr. Toosi’s decisions and the hospital’s responsibilities must be examined. Neither can be allowed to escape scrutiny.
This is about more than one doctor or one hospital. It is about the responsibility that comes with caring for children and the trust families place in medical professionals and healthcare institutions. When that trust is shattered by events this serious, families deserve transparency, answers, and meaningful accountability.
Vincent’s life has been changed forever. Our family cannot undo what happened, but we can demand that those responsible confront the questions surrounding his care and that meaningful action be taken to protect others.
Mercy Gilbert Medical Center and Dr. Aryan Toosi must answer for the care Vincent received. We demand immediate action, an independent investigation, and accountability wherever the evidence leads.
Every child deserves safe, attentive care. Every family deserves the truth. And no family should have to fight to make a hospital and its physician answer serious questions about the care of their child.
