Justice for the victims of the Israel-Hamas war and beyond now!

The Issue

Some of the top leaders of Hamas, Khalil al-Hayya, Mousa Abu Marzook, Abu Omar Hassan, Zaher Jabarin, Basem Naim, and Khaled Mashal, are currently residing in Qatar as well as Turkey. While they live in luxury, thousands of innocent people suffer and die due to their countless human rights violations and acts of terrorism. On October 7th, 2023, Yahya Sinwar, a now deceased leader, masterminded the brutal attacks by Hamas on Israel (Most brutal and evil attack on the Jews since the Holocaust). For about a year now, this war has raged on, claiming the lives of countless innocent people in Israel and many Palestinians. The selfish and destructive ambitions of Hamas to annihilate the Jewish state have inflicted untold pain on the very people they claim to defend.

We implore the government of Qatar and Turkey to help end one of the greatest injustices of the 21st century by turning over these individuals to the International Criminal Court (ICC). As of May 20th last year, the ICC has issued an arrest warrant for Ismail Haniyeh (who is now dead) but should extend this to include other Hamas leaders, like Khalil al-Hayya, Abu Omar Hassan, Zaher Jabarin, Basem Naim, and Mousa Abu Marzook. In addition, Khaled Mashal, despite his significant role in Hamas, has yet to face such legal accountability. The ICC, with its mandate to prosecute crimes against humanity, war crimes, genocide, and aggression, is the appropriate body to bring these leaders to justice. The cries of the victims demand that all these perpetrators be held accountable.

We also beseech Lebanon to surrender the leaders of Hezbollah, (Mohammed Aknan) to the ICC. These leaders have orchestrated groups responsible for heinous crimes against humanity during the Israel-Hamas war and beyond, perpetuating a cycle of violence and suffering. We call on the ICC to issue arrest warrants for these individuals, ensuring that they, too, are brought to justice.

Additionally, we urge Syria to turn over the leaders of the PFLP (Jamil Mezher), DFLP (Nayef Hawatmeh), and PFLP-GC (Talal Naji) to the ICC, as they have also directed groups responsible for such crimes. The ICC must also issue arrest warrants for these leaders to ensure comprehensive accountability.

If we succeed in bringing these leaders to justice, it will send a powerful message that the international community will not tolerate terrorism and crimes against humanity in one of the darkest times of this century (If not the darkest), and history overall. This could pave the way for a more peaceful and stable region, where the rights and lives of innocent people are protected.  Moreover, their removal would weaken these various terrorist groups' operational capabilities, making it easier for Israel to address the threat posed by these groups in a more surgical and less risky manner. Conversely, if these perpetrators continue to evade justice, it will embolden them and others to commit further atrocities, perpetuating a cycle of violence and suffering. The stakes are high, and the outcome will significantly impact the prospects for peace and justice in the Middle East and beyond.

We must act now to end the impunity of those who commit such monstrous crimes and bring hope and peace to the afflicted. We call on the ICC to expand its efforts and issue arrest warrants for all these leaders, ensuring justice is served for all victims.
