The Issue

My son's life was turned upside-down by mental illness. One tragic day, he lost control due to the untreated voices in his head and hurt a family member. Despite the undeniable evidence of his mental health struggle, the court system chose to place him in protective custody for 11 months. During this time, he was not given the proper evaluation or treatment he so desperately needed.

This experience is not unique to my son. Across Massachusetts, courts are failing to recognize the complexities of mental health issues in offenders, choosing instead to default to incarceration over evaluation and treatment. Statistics from the National Alliance on Mental Illness reveal that approximately 1.2 million people living with mental illness are incarcerated in the United States, often without receiving adequate mental health care. This means many individuals are suffering in silence, trapped in a system unequipped to handle their specific needs.

The current judicial approach not only fails these individuals but also adds unnecessary costs to our state’s budget due to prolonged incarceration. According to the Massachusetts Department of Corrections, processing and housing an inmate costs the state an average of $55,000 per year. Alternatively, mental health programs focusing on intervention and evaluation can cut down costs significantly while offering humane treatment.

We need to advocate for a reform in the Massachusetts court system that prioritizes mental health evaluations and treatment over incarceration. With proven models in other states, such as mental health courts and specialized programs, we have a blueprint to follow that ensures better outcomes for those with mental health disorders involved in criminal activities.

By implementing these changes, Massachusetts can become a leader in compassionate and effective mental health care within the legal system, ensuring justice while addressing the root causes of criminal behavior linked to mental illness.

I urge the community, legal professionals, and policymakers to support this cause. We must push for legislative changes that mandate evaluations for offenders suspected of having mental illnesses, and prioritize the establishment and funding of mental health courts across the state.

Sign this petition to demand the Massachusetts court system to reform its approach towards mental health issues in offenders, ensuring justice is achieved not just by punishment, but by understanding and addressing mental health needs effectively.
