Transfer Kevin Herrick’s Case to a Conviction Integrity Unit for Independent Review

The Issue

Kevin Richard Herrick was found guilty of a crime he did not commit on his 24th Birthday. This is in spite of the fact that, none of the fingerprints, hair fibers or any other physical evidence associated with the crime matches Kevin. To make matters worse, victim depositions and their court testimonies confirm that the police told them that the bloody knife and bloody cloths were recovered from Kevin’s bedroom on the night of the incident. Yet this is simply not true and confirmed with forensic testing.

So, as a result of this police misconduct along with Kevin’s ineffective legal counsel from his drug addicted alcoholic defense attorney, and sentencing errors and assumptions made by the Judge, Kevin, was handed an undeserved life sentence of incarceration without the possibility of parole for armed burglary and sexual battery along with a concurrent 15-year sentence for aggravated battery.

Kevin has maintained his innocence since day one and even turned down a plea deal which would have released him in 1993, but instead Kevin believed in the court system for justice and that the truth would prevail.

While the DNA evidence could fix this miscarriage of justice, the courts ruled against the Innocence Project of Florida's petition in 2006 and appeal in 2008 thus preventing them from having custody of this evidence.

Kevin has exhausted his district, state and federal appeals and has no opportunities for relief available. Kevin has already spent over three decades in prison and even if he had committed the crimes for which he was convicted, a life sentence is a punishment that does not fit the crimes.

But there is something we can do. Please join us in urging Bruce Bartlett, State Attorney for the Sixth Judicial Circuit of Florida, to release all of the unidentified fingerprints and hair fibers to the Innocence Project of Florida for DNA testing and/or transfer Kevin Herrick’s case to another circuit with a conviction integrity review unit (CRU).
