We, the undersigned, are calling on the Fulton County District Attorney’s Office to immediately appeal the recent federal court ruling that effectively denies justice to Jimmy Atchison and his family.

On January 22, 2019, Jimmy Atchison, an unarmed 21-year-old father, was shot and killed by Officer Sung Kim during the execution of a warrant in Atlanta. Now, a federal judge has ruled that Officer Kim—who was acting as a federally deputized officer—cannot be held accountable in state court, even though he shot and killed an unarmed man who posed no immediate threat.

This decision sets a dangerous precedent: it suggests that law enforcement officers deputized by federal agencies are above state prosecution—even in cases involving the killing of unarmed citizens. We cannot let this blow to justice stand.

We demand the following:

    •    That the Fulton County District Attorney’s Office immediately appeal this ruling to the 11th Circuit Court of Appeals.

    •    That every legal avenue be pursued to hold Officer Sung Kim accountable in a court of law.

    •    That the integrity of Georgia’s ability to prosecute officers who violate the rights—and take the lives—of its citizens not be undermined by this decision.

Jimmy Atchison deserved due process. His life mattered. And his family deserves justice.
