To the Public, the Press, and the State of Florida:

This is a formal declaration issued on behalf of Jimmy — a Muscovy duck cherished by the Cape Coral community — who was wrongfully removed from his habitat under the false pretense that he was a feral, unowned animal. We are not seeking Jimmy’s return. We are filing civil action to establish one truth:

Jimmy must be free.

Let the record show:

Jimmy was not wild. He was raised by humans, bonded with people, and exhibited unmistakably domesticated behavior — including gentle physical interaction, calm proximity to strangers, and total absence of flight response. No wild Muscovy acts this way.

No due process was followed. Officials failed to assess his behavior, determine custody, or weigh his welfare. Jimmy was treated as nuisance wildlife, not as a living being with a history.

His seizure was carried out under 50 CFR § 21.12, a statute that permits removal of feral Muscovies. But Jimmy’s conduct and socialization prove he was not feral. The application of this statute was legally and biologically incorrect.

The action also violated F.S. § 828.12, which prohibits unnecessary torment. Uprooting a peaceful, bonded animal without care or context is cruelty under the law.

No special permit under 50 CFR § 21.14 was granted for the removal of a domesticated duck — a further procedural failure.

This is not just a duck. This is a test of how we classify life — and how institutions weaponize mislabeling to avoid accountability.

Our demands are clear:

• That Jimmy be legally recognized as free to remain in the wild, beyond the reach of agency recapture or confinement.
• That state and federal wildlife policies formally differentiate between feral and domesticated Muscovy ducks.
• That a full investigation be launched into Jimmy’s removal, transport, and current custodial status.

As part of this campaign, we are also spreading awareness through online communities and the Solana blockchain. This case is being etched into immutable digital record — so that Jimmy’s story cannot be erased or ignored. On-chain and off-chain, we will be heard.
