The Issue
Gary was wrongfully convicted 9 years ago by South Carolina and Chesterfield county, and here we will showcase evidence to prove this story true. You can view more on the website made for his story: www.sc-garymoore-scdc.info
First and most important: the state did not find findings of facts or conclusions to have a reason to deny Gary immunity. He qualified in every way for immunity. Second, the 911 audio being omitted is a Brady Violation, meaning the state is required by law to give Gary retrial or release him as this violation is grounds to reverse his conviction altogether and also due to the fact of the state not having findings of facts and conclusions to deny him immunity at the hearing.
Chesterfield County, SC and the State of South Carolina, USA, used an altered fourth video at trial. They can no longer provide this fourth video but they do admit its existence in trial and PCR transcripts. They had the courthouse delete this video after trial because Gary called it out as being altered and fake. The courthouse can not provide this video and did not provide it before trial; the courthouse did not submitted this fourth video to Gary or his lawyers for discovery. It allegedly had Gary going around in circles “stabbing everyone” and “chasing Charles” while “Charles tried to get away”, according to Investigator Graig Burns, explaining the video in trial transcripts, to everyone. They only played this one fourth video at trial, not the first three (that play out the same scene, unlike the fourth video). They had no idea about this video until it was played at trial. The fourth random altered video was used to convict Gary. The photos below are transcripts of them admitting to a fourth video's existence at trial and at PCR.




Gary was going to the gas station at McCormick's Grocery in Jefferson, SC. You can see this in one of the videos provided in his discovery; he pulls up in his work truck by a gas pump, gets out of his vehicle and goes into the store. (You can watch this part in one of the videos on the website I made at www.sc-garymoore-scdc.info/evidence )
Charles Wallace comes up behind Gary and hits Gary in the head with his left hand. Gary, who’d walked into a dim-lit store after being outside in the bright sun, could not see, so being hit in the head came as a shock. Gary fell over onto Charles, and Charles grabs Gary by the hair of his head seconds before they reach the ground, so Gary couldn’t get up and away. Charles then wraps his legs around Gary, and Gary is continually pushing away from Charles with his right arm. (Since it is easier to see when slowed, below I have provided a slowed and more detailed version of this video as well as the original, this is one of three videos submitted to discovery). Note that the videos provided are from discovery, I was not the one to record these videos from a phone to a monitor. Apparently the people at the scene could not get the videos off the tapes so they recorded it from a phone of the monitor playing the videos, we know it is a bit hard to see due to this fact, but you can still see enough of what goes on in these videos to know that Gary was attacked first and had two people ahold of him.

Now for the audio: Following the fourth altered video, is the Omitted 911 audio by Melissa Griffin, that was never played at trial due to the fact that it was omitted (they did not to play it - this is the brady violation), the crucial evidence from the 911 audio proves Gary did not make a false statement Melissa Griffin claims he said at the doors, in his Voluntary interview, because You can hear Gary yelling out “Get off of me!” And you can also hear Gary yelling out “Well I’m Sorry!”. I have provided the audio with captions below but you can listen to it without captions if you want to.
At trial and in the statement Melissa wrote, she states Gary said “he got what he deserved” or “he had it coming” (the state and Melissa couldn’t and the State still can’t even decide which version of this false statement Gary said, ironically). Melissa Griffin committed perjury by lying in court about what Gary said that day before leaving the doors to call 911 himself. Perjury can result to 4+ years imprisonment. Knife photos used: People often ask “why is this important, he stabbed Charles four times so why does blood on the knife matter or not?” When you look at these photos, there is blood and water on the blade. Ask yourself this: how could water droplets be on the blade with blood? Inside the handle is just lint, dust and dirt as well - you would think there would be water and blood inside the handle when the knife was closed before the bodycam footage was shut off, right? This does not counteract the fact that Gary did defend himself with the knife, it just shows that there was possible tampering of evidence with the intent of interfering with investigations and court process which is a crime in South Carolina.
Tim Hutchinson also states at trial that he’d never met Gary prior to this incident, but as you see in the video cam footage, he agrees when Gary asks “you were there when he tried to attack me at magistrate court, this is the same guy."

Charles Wallace admits to every element of attempted murder in trial transcripts. Charles also attacked Gary prior with an axe handle, and then again at court in-front of a judge (Gary was still denied a restraining order), even threatening to kill Gary “at a store or somewhere”. He has tried to hurt Gary before.







I was not given the shirt photos, but allegedly... the shirt had multiple holes stabbed into it (keep in mind that Gary only stabbed Charles four times, so it would be impossible to have more holes in a shirt of someone who was only hit four times). This would mean more possible tampering of evidence, a crime in South Carolina. The three videos submitted to discovery play the same scene. Gary getting attacked first and two people having hold of him towards the end before he gets away.
Gary was trying to get out of their grip and finally escapes, nicking Steven (you see Steven jerk backward at the door), but Steven states he doesn’t know how he got a nic, but in the video he was trying to grab Gary again and gets a nic then. Steven also was not sober during his the incident as you can hear in the full 911 audio by Melissa Griffin, so his recollection of the incident should have been omitted, anyways.
The state of South Carolina and Attorney General Alan Wilson are still trying to argue why he should be in prison when all evidence in his case says otherwise. Gary tried to get PCR but was denied and his case was finally sent to the Supreme Court. Attorney Robert Dudek has done an great job covering his entire case in his writ petition, I still need to submit it onto the website I made which I plan to do ASAP, with other documents. The Supreme Court has sent his case back to the appellate court and is ready for consideration as of now. Appellate court takes forever to do anything unfortunately.
I hope everything I have presented to whoever reads, compels you enough to sign the petition, share and pressure the governor to pardon Gary. Thank you so much for reading.
