Justice for Dana Rivera: Pass Mandatory Jail Time for All DUI Offenders in Florida

The Issue

On February 28, 2025, Dana Rivera—a devoted mother of four, a wife, and a beloved member of the Tampa community—was killed by an impaired  driver on Gunn Highway. The driver, Nicholas Betancourt, had been arrested for DUI just hours before the crash. He was released from jail that same morning. Despite having his license suspended, he was back behind the wheel—this time under the influence of cocaine, meth, and other substances. He crossed the center line and hit Dana head-on. Dana died on the scene. Three of her young children were in the car and were severely injured. Dana’s death devastated her husband, Albert, her children, and everyone who loved her. Her family is leaning on their faith in Jesus to survive what can never be repaired. But this is not just a tragedy. It’s a failure of Florida’s laws. A suspended license didn’t stop this driver. A fine wouldn’t have saved her. Only real consequences—mandatory jail time for all DUI offenders—can stop this from happening again. We are calling on Florida lawmakers to pass legislation that:   Requires mandatory jail time for all DUI convictions
Increases penalties with each repeat offense
Includes fines, community service, and long-term breathalyzer monitoring   Every person who drives under the influence should know that choosing to risk someone’s life could cost them their freedom.
