In Montana, a motorist who causes the death of another person while driving negligently can be charged with “negligent homicide.”
Let's face it, Courtney would still be alive if the driver hadn't driven with negligent carelessness. Had the driver exercised careful and prudent driving, a person would not have lost their life. The police report states clearly the cause of the accident was due to careless driving. MHP also told reporters on the day of the accident that, "speed is a suspected factor". Why is Granite County protecting the driver when he could be charged with no valid driver's license and careless driving? We are simply asking the county attorney, Blaine Bradshaw, to do what is right and hold the driver accountable.

These laws allow motorists to be stopped even if they are not exceeding the posted speed limit if the speed at which they are traveling is considered too fast for conditions or dangerous to others on the road.
Careful and Prudent Driving: Montana law also requires motorists to operate their vehicles in a careful and prudent manner and at a reduced rate of speed, taking into account the traffic, weather, visibility, and road conditions.
Drivers must operate their vehicles with regard for the safety of people and property and in such a manner that they do not endanger the life, limb, property, or other rights of people entitled to use the highways.
