Justice for CHOUAIB

The Issue

Chouaib is a Moroccan American who immigrated to Arlington Virginia seeking the American Dream. Chouaib was a hard-working truck driver who worked intensely to provide for his wife and children. He truly loves his family and community. 

Chouaib was falsely accused of marital rape in early 2022, several facts admitted by his defense attorneys to Arlington Circuit Court proving that Chouaib is a person with good moral character and reputation and never committed any marital rape but was a normal consensual husband-wife relationship, this case is about a minor marital disagreement escalated to a marital rape claim.

It was unfortunate that the outcome of Chouaib’ trial hinged on who’s sitting on the jury panel. In Arlington District Court, the panel is representative of Arlington County’s population, which is about 74 percent white. In Chouaib’s case it was unfortunate that his Juries were 99.99% white who found him guilty!

Moreover, Arlington Circuit Court is lacking language and dialects barriers which is a groundbreaking in sensitive cases like marital rape accusation, which leave both the court staff, the Commonwealth, and the Defense Attorneys to accommodate language diversity. 

Because Morocco has been ruled by many different governments and empires over time-including its colonization by the French and Spanish in the twentieth century – Darija dialect has mixed influences. While its base is Arabic, Darija contains Amazigh (the native “Berber” languages), French and Spanish. Most Middle Eastern nationals find that Moroccan Darija is a tough language to understand, read and interpret. Not only is it very different from Modern Standard Arabic. Moreover, people who speak Arabic who are not Moroccans nor have lived a reasonable period of time in Morocco to learn the Moroccan dialect, do not understand it and should not participate in court proceedings as interpreters for Moroccans who do not speak English. Unfortunately, none of the interpreters in Chouaib's case were Moroccans nor spoke Moroccan dialect.

What this petition is asking for:

We the Moroccan American community the undersigned, respectfully believe this harsh sentence was imposed merely to uphold judicial errors and request your honorable court to consider granting retrial of Chouaib case.
