Dear advocates,

For years, you’ve helped us push for a safer, more just New York. Because of your commitment, this campaign has reached thousands, raised public awareness, and built pressure on lawmakers. But we are not done.

Right now, New York law still allows a dangerous loophole to stand—one that denies justice to survivors of sexual assault who were voluntarily intoxicated.

This is called the Voluntary Intoxication Exclusion. It means that if a survivor had been drinking or using drugs of their own accord before the assault, the law does not consider them “mentally incapacitated.” As a result, the rape statute may not apply. Perpetrators walk free, and survivors are left without a path to justice.

This legal gap does more than fail survivors. It sends a chilling message: if you choose to drink and become voluntarily intoxicated, justice is not applicable for your assault. 

That is unacceptable.

We’re calling on the New York Legislature to pass A101/S54, which will eliminate this exclusion and protect all survivors, regardless of how they became intoxicated.
