✅ Across the last 20 years, following passage of such legislation rape rates dropped 15% across states (stats from state crime index and fbi data)
✅ Research shows this "Deterrence Effect" hits younger populations and would-be first time offenders in particular as data shows biggest shift around college areas - aligns with criminology's "certainty hypothesis"
✅ This bill is needed because of viable Case Law from a 2014 case that overturned a rape conviction originally pleaded guilty - the reasoning was because "voluntary intoxication" is NOT codified in current penal code.
✅ This bill has bi-partisan support and the majority of the Assembly, Legislative Women's Caucus, Codes Committee, and Rules Committee are currently sponsors.
The Senate did their job. They followed the steps of Democracy, put it to a vote, & passed it. They pass it every year.
The Assembly has never brought it to the floor. The Assembly had its sponsor
Asm. Dinowitz work very hard to support this bill and mentioned he sees no reason this bill wouldn't pass on the floor.
He says he needs to support of leadership to move forward. And Assembly Speaker Carl Heastie is at the the top!
The Speaker needs to hear more support from the public to know this is an issue we are voting on come this election season!
