Justice for Adam Denton: Reinstate Lifesaving Services and Investigate KDADS Corruption

Adam Denton, a severely autistic man in Sedgwick County, Kansas, is in extreme and immediate danger of fatality.

This is not due to his disability, but due to the deliberate, cruel, and allegedly criminal actions of the very state agency tasked with his protection:  the Kansas Department for Aging and Disability Services (KDADS).

Adam's life-sustaining Intellectual/Developmental Disability (IDD) Home and Community Based Services (HCBS) waiver services have been wrongfully terminated based on what we believe to be a coordinated conspiracy of fraud, corruption, and intimidation that must be stopped.

The foundation of this crisis is an act of blatant fraud. We have reason to believe that Robin Loman, Stephanie Volle, and Leigh Smith of KDADS conspired with two staff members at the Sedgwick County Developmental Disability Organization, Heather Pace and Sherry Arbuckle, to intentionally falsify Adam’s eligibility determination instrument (EDI) and Basis functional assessments. This fraudulent act stripped Adam of the services he desperately needs to live, effectively signing a death warrant for one of our state's most vulnerable citizens.

When Adam’s care team attempted to fight this injustice through legal channels, they were met with a wall of what appears to be systemic corruption. We allege that officials have gone so far as to bribe Administrative Law Judges at the Kansas Office of Administrative Hearings to purposely deny Adam his legally protected right to a fair appeal. This action demonstrates a shocking contempt for the law and for Adam's life.

The conspiracy to harm Adam extends to a campaign of terror against his caregivers. KDADS officials have directly threatened Adam’s providers, warning them that if they provided for any of his medical needs or even dared to advocate for him, their professional licenses would be revoked. This has created an environment of fear, effectively isolating Adam from anyone who could help him.

In a horrifying tactic of victim domination, KDADS has illegally forbidden Adam from communicating with anyone besides his abusers within the agency. There is no court order justifying this flagrant violation of his First Amendment rights. This is a deliberate strategy to silence Adam and conceal these abuses from the public and from other authorities.

Tragically, the system designed to be the last line of defense has also failed Adam. The Disability Rights Center of Kansas, the state's designated protection and advocacy system, has refused to provide equitable access to legal assistance, reportedly based on a complete falsehood from a verbally abusive attorney.

This cannot be allowed to stand.

We, the undersigned, are horrified by this cruel, corrupt, and criminal conduct. Adam Denton's life is on the line. This is not just about one man; it is about the integrity of a system meant to protect the most vulnerable. If state officials can do this to Adam, they can do it to anyone.

Therefore, we demand immediate action:

  1.   The immediate and full reinstatement of Adam Denton’s IDD HCBS waiver services to ensure his safety and well-being.
  2. A full and independent investigation by the Kansas Attorney General's office into the conduct of Robin Loman, Stephanie Volle, Leigh Smith, Heather Pace, and Sherry Arbuckle for fraud, conspiracy, and the violation of Adam Denton's civil rights.
  3.  An investigation into the allegations of bribery and corruption within the Kansas Office of Administrative Hearings to ensure the integrity of the appeals process for all vulnerable Kansans.
  4. The immediate cessation of all threats and intimidation against Adam's providers and the restoration of his First Amendment right to free communication.
