The Issue
PETITION TO THE HOUSE OF COMMONS
in the case of
JUSTICE FOR TIM McLEAN
PETITION TO THE HOUSE OF COMMONS TO HAVE VINCE LI RETAINED IN THE HEALTH SCIENCES PSYHEALTH UNIT IN WINNIPEG MANITOBA WITH NO UNSUPERVISED PASSES OR MOVE TO A GROUP HOME:
WHEREAS: Vince Li has committed a heinous act in killing, beheading, mutilating and cannibalizing Tim McLean.
WHEREAS: Vincent Li was found Not Criminally Responsible on Account of a Mental Disorder for the murder of Tim McLean at that time; has be detained in treatment facilities and not prisons until proven to be mentally stable to stand trial for and with the comprehension of his crime; the denial of unescorted passes to such an individual, and the condition that escorted passes could only be granted for medical reasons and subject to sufficient safeguards to protect public safety.
WHEREAS: offenders found guilty of first degree murder are sentenced to life in prison without parole for twenty-five years and those found guilty of second degree murder are sentenced to life without parole for a minimum of ten years; should Vince Li prove well enough for trial and found guilty, we ask that he receive a life sentence with no parole and be detained in a locked, supervised psychiatric facility.
WHEREAS: there is no minimum period of detention for offenders found Not Criminally Responsible on Account of a Mental Disorder and their cases may be reviewed every year by a Review Board Committee while including family and their impact statements as well as other sustainable people to testify.
We, the undersigned, citizens of Canada call upon the House of Commons:
TO: Amend the Criminal Code of Canada to ensure those who commit murder in all manners including and especially by decapitation and cannibalization as in this particular case, but are found Not Criminally Responsible on Account of a Mental Disorder are detained for a indefinite period of time for and including supervision of Vince Li to ingest required and prescribed medications to prevent future psychiatric occurrences and continue treatments in a long term locked facility with no unsupervised passes due to proof of evidence that Mr. Li has been known to cease taking his required medication, due the percentage of NCR individuals still under the preview of a review board three years after their court verdict who were convicted or found NCR for a new offence. Whether Mr. Li is likely to re-offend should be a mute point. The reality is that he should never have the opportunity. Why? Because for the most part, the judicial verdicts provide minimal assurances that the criminal behavior will not be repeated on another family by the same individual at a later date. Therefore, since there have been some recent changes by Ottawa to this portion of the Criminal Code and as a result of federal legislation passed last year, a person found to be not criminally responsible for a crime can now be designated as a high-risk to re-offend. This new designation would place greater restrictions on a NCR individual who falls under that classification. It would also limit the number of review hearings that the individual appears before, which can provide the families of victims some degree of relief. Therefore, Vince Li should be designated as a High Risk Offender, relinquishing all right to unsupervised outing but to be in a locked supervised facility for life.
AND FURTHER THAT: Vince Li, who; after over six (6) years since the stabbing, beheading and cannibalization of Tim McLean on July 30, 2008 on a Greyhound bus and being treated in psychiatric facility in Selkirk and the PsycHealth Centre at HSC; be determined now as being mentally stable to stand trial, be convicted and sentenced to life with no parole in a locked, supervised psychiatric facility; rather than a prison; with continued treatment for the death of Tim McLean and not be allowed to move into a supervised group home in Winnipeg; seeing as his team says he has not had hallucinations in more than a year and he has expressed remorse for his crime. t is quite evident that Mr. Li understands the nature of his crime. It is of general opinion that the crown prosecutor never fulfilled their legal duty to the people they represent. Dr Stanley Yaren was called by the crown as their star witness…. actually, their only witness; whereas police, paramedics, family and other notable witnesses should have the opportunity to present testimony. It is apparent that in a trial all mentioned and the psychiatric team should present testimony.
