October 20, 2025 — Yesterday, the Yukon Supreme Court Justice presiding over Eli LaRue’s Faint Hope Clause hearing acknowledged the importance of fairness and full transparency in Norman’s case.

The Justice stated that she would like Eli to be represented by legal counsel and confirmed that a Notice of Constitutional Question has been added to the case — an important legal step that must be properly overseen by a lawyer. 

She also made clear that she will personally review all documents submitted, including those connected to Eli’s Judicial Review regarding false “institutional subculture” allegationsmade by Correctional Service Canada (CSC).

This is a vital moment in Eli’s pursuit of justice — but we are still facing serious systemic barriers.

Despite multiple applications, Legal Aid BC has declined to provide funding for Eli’s representation. The first appeal was written by Tom Engel, a respected lawyer known for his advocacy in criminal justice and civil rights, and the second appeal was written by me, Jennifer LaRue, on Eli’s behalf.

Now, the Justice is awaiting Legal Aid BC’s response — and this decision will determine whether Eli can properly challenge CSC’s false claims and ensure that the court receives the full and accurate record before deciding his case.

Access to justice is not optional — it’s a right. Legal Aid BC has a statutory duty to ensure that those without means can still exercise their constitutional rights. Denying legal support in a case that involves Indigenous identity, systemic discrimination, and questions of fairness within Canada’s correctional system is unacceptable.

We are calling on the public, media, and justice advocates to keep watching, sharing, and demanding accountability. 

Eli’s case is about more than one man — it’s about the right to a fair process for every person facing systemic injustice in Canada.
