The Issue

This whole ordeal began on september 25th 2005, while Kenny was having an adverse reaction to the medicine Zoloft which his doctor prescribed. Sadly, on that tragic day this incident occurred. Kenny had been misdiagnosed by his family doctor physician as having depression and anxiety. When in fact he suffered from bipolar disorder. It is well-known in the field of psychiatry that a person who is bipolar should never take an antidepressant alone without a mood stabilizer. The misdiagnosed disorder along with the result of a DNA test taken June 13th 2019, which scientifically proves that Kenny, along with only 7% of the population in the world, has a mutated gene which does not allow Kenny to properly metabolize Zoloft. This is precisely what contributed to the events leading-up to the death.

At the time, prior to, during, and shortly after Kenny’s trial, no one knew what role Zoloft played in Kenny’s actions. Kenny had no psychological testimony in front of his jury. This matter has since been thoroughly investigated. What has been discovered through DNA testing by Selma Eikelenboom, M.D., is that Kenny has a genetic predisposition that classifies him as an “Intermediate Metabolizer '' who processes antidepressants like Zoloft much slower than the normal person. Consequently, Dr. Eikelenboom will testify that slower metabolism contributes to a significant risk of adverse effects due to the medication building-up very quickly in the system. This is known to cause manic episodes and irrational acts of violence. When Kenny wins this appeal, Dr. Eikelenboom will also testify in the civil proceeding that Kenny never should have been prescribed Zoloft by his family physician and he had absolutely no business being on that medication at the time of the murder. Also, one psychiatrist and one psychologist has opined that the Zoloft should have never been given to Kenny because he was bipolar and it made him severly manic at this time of the murder.

It is our belief that Kenny is actually innocent of murder due to involuntary intoxication. A matter directly attributable to the family doctor erroneously prescribing him Zoloft. As well as Kenny’s genetic predisposition towards the slow metabolization of Zoloft. All of which is newly discovered evidence that has been painstakingly acquired through due diligence. Further, Kenny had no psychological testimony at his trial.

We are now at the point of needing a lawyer who is aggressive with proven experience, at litigating a case like Kenny’s. We need an attorney who is experienced in both criminal and civil litigation. As attorney Chris Ryba has suggested, that, “there is a substantial medical malpractice lawsuit if Kenny wins his appeal.”

Without doubt, the scales of justice must be set right. With your help it will be done in such a way that everyone affected by this unfortunate loss of life will be given the opportunity to finally heal
