Save Our Hays County Groundwater, Aquifers, Wells, Streams & Springs

We hope we can persuade you to help us and our fellow Texans confront a very real threat to our state’s most valuable natural resource … water.

As residents of Hays and neighboring counties, we have been concerned by the recent actions of a Houston-based commercial interest, Electro Purification. EP has found a loophole in our state’s groundwater protection system and has begun to pump a proposed Two BILLION gallons of water annually from the Trinity Aquifer, over which much of Hays County is located and many rely on.

This water is being removed with no regard to the aquifer, nor the residents and businesses who already rely and whose use is regulated. This is possible because the area in which EP is drilling is a “white zone,” outside the jurisdiction of any regulatory body.  Hays County Commissioner Will Conley recognizes the unethical manner if which is EP’s modus operandi, as nearly 60% of their business is conducted in this manner and the harm and threat it places on all “others’ investments and quality of life”.

Hydrogeologists for the City of Buda, which itself is contracting with EP for water, predict the aquifer level will drop by 300 feet if EP continues with its proposed operations and without a doubt will affect surrounding wells requiring them to lower their well heads 300 feet.

EP’s disregard for the social, environmental and financial impact on Hays’ County neighbors and businesses is undeniable and their ethics questionable.

We ask you and others to introduce legislation that would bring these “white areas” under the jurisdiction of regulatory bodies, such as Hays Trinity Groundwater County District and to help fund them. We ask you to please study and promulgate a better solution to our water issues than the “rule of capture” as it is presently being interpreted by the Texas Supreme Court.  Close this loophole; one of many such loopholes across the state. Ensure your constituents’ water supplies are protected.
