Justice for G'Niya (2yrs); Victim of Domestic Battery to her Pregnant Mother by her Father

The Issue

My daughter (G'Niya) and I(Genia) are survivors of Domestic Battery. October 23, 2016 while I was 6 months pregnant with my daughter (G'Niya), I was kidnapped and abused by her Father. I suffered black eyes, eye injury, a broken nose, a fractured cheek bone, a sprained ankle and throughout that traumatic event my daughter and I surprisingly survived. Immediately, after about 9 dreadful hours (9pm-6am) of attack, intimidation, fear, physical and emotional abuse I was released from the Abuser ((unborn) G'Niyas Father) and got medical attention, and took every possible legal action to assure the safety of G'Niya and myself. Although the journey was not easy I pressed charges, filed for an injunction and did my very best to provide a safe and healthy environment for my child/children and myself. The abuser continued to contact me and threaten me; for fear of my daughters and my life I fled to North Carolina. Even after leaving Florida my abuser would continue to call me and imply he knew where I was and would always be able to find me. Being that I no longer live in Florida, the injunction is useless, I had to discontinue counseling, and all other help provided to my daughter and I that would assist us in becoming reestablished as Domestic Battery Survivors. Essentially, there was no help for my daughter and I as her Father (the abuser) continued to defy the law. My injunction is still current and has no expiry date.

After the traumatic attack, injuries, losing my job, delivering our daughter early, breaking my lease, moving to North Carolina and starting over from ground zero; I find myself in court once again per the request of the abuser. He's petitioned the court to have a parent plan put in place forcing me & my daughter to travel 4 hours from our safety to meet him and he take my defenseless daughter (G'Niya) to his home back in Florida, a parent plan that says we must split rights of our daughter (G'Niya) 50/50. The courts has granted him his request after I paid $3000 to retain a Lawyer, commuting back and forth to North Carolina and Florida, having a recommendation of a Magistrate to dismiss the abusers petition, and having confirmation from the courts (June 2018) that this case was closed in mine & G'Niya's favor. Please help me protect my daughter from the possible dangers that she has already escaped one time before.

Help me make a bill/law; that will prevent victims from being further tormented and victimized through a nasty Custody Battle or the worry of Parent Planning/ Time-Sharing with an unstable individual(an abuser).  A pregnant woman that has survived Domestic Battery and is still fortunate enough to walk away with that unborn child, shouldn’t have to fight for that same child’s safety from the abuser ever again. Convicts can’t vote, woman that are more than three months pregnant can’t have abortions and abusers of a pregnant woman should not have a right to petition for Custody, Parent Plans/Time-Sharing of that child that he/she inflicted harm upon. My hopes are to get a bill/law in place that states, “No individual (man or woman) that stands in legal violation of the law for any physical Domestic Battery against a pregnant woman "Can Not" petition for Custody, Parent Plans or Time-Sharing concerning that child that also survived the abuse".
