Moses. Just look into his sweet eyes and you see the pain and suffering he's endured from obvious starvation and ultimately Renal Failure with symptoms that can include vomiting, lethargy, diarrhea, constipation, depression, weight loss, anorexia, just to name a few. The owner, Brian Kenney, of No. Providence, Rhode Island, claims he couldn't afford veterinary care. Moses was the unfortunate soul that had to be euthanized because of this man's ignorance. The charge against him is "Unnecessary Cruelty to Animals" which is a misdemeanor in R.I. (4-1-3) The punishment for this misdemeanor is a $50 - $500 fine and/or up to 11 months imprisonment. According to the law, it would be a felony if he abandoned poor Moses. What is the legal definition of abandonment? In short, if you leave him/her in a parking lot, or elsewhere, with no intention of returning, as opposed to having him/her in your home or on your property and fail to provide necessary sustenance. What's the difference? The location of the abuse? If it is found that it was Intentional Cruelty the fine increases to $1000 and/or 2 years possible imprisonment.
And finally, this man has two other dogs that were taken from the home and found to be in decent condition but without rabies shots. He can and will likely get them back after they are vaccinated. If he pleads nolo contendre or no contest "based on the discretion of the sentencing judge, not possess or reside with any animal for a period of up to five (5) years following entry of the conviction or upon acceptance of a plea of nolo contendere by the court. Any offense under this subsection is a misdemeanor punishable by a fine of not more than one thousand dollars ($1,000), by imprisonment for a term not more than one year, or both, and forfeiture of the animal(s)".
Please help me in speaking for Moses and getting the just punishment that Brian Kenney deserves. Mr. Kenney will never feel the pain and suffering Moses went through and probably doesn't care. But I believe he'll understand a bit more if he's punished to the fullest extent of the law.
We must appeal to the judge presiding over this case, hope for compassion on his part, and show other animal abusers that Rhode Island will not tolerate the human infliction of pain and suffering, neglect and abuse brought onto these animals by less than human "beings".
