Reciprocal Discovery: The Defendant’s Obligations -
I have quoted from the Center for Court Innovation publication [also attached], to show that there have been revisions to the discovery law form requirements that allow for further delay of providing 'reciprocal discovery' [on the defense side].
"The 2020 amendments relaxed some of the timeframes created in the initial version, After reasonable diligence, if the defense is unable to provide expert opinion evidence and tangible property is unavailable for disclosure, the timeframe of 30 days after the prosecution’s filing of a certificate of compliance can be stayed without the need for a motion. The disclosure must then be made as soon as possible. ..... "
