Join to defend our access to Playa Agua Caliente! It’s your right!

The Issue

The La Paz community, for many generations, has enjoyed the unique attractions of Playa Agua Caliente (including the only natural thermal springs in Baja Sur) accessing it since at least the 1980s by a historic road that connects El Sargento and El Jalito.

However, a private developer named Devangari which owns adjacent land has illegally blocked the public road to the beach - placing containers to close the road, erecting walls, and dismantling access to bike and hiking trails in order to build a private beach club in front of the beach.

In response, the La Paz City Council applied to SEMARNAT for an acuerdo de destino, which would allow the municipality to protect and conserve the beach for public activities. The federal agency responsible, SEMARNAT, has not yet responded to the application—despite that the application is pending for three years.

We must demand action to protect our access to the beach!

For these reasons, the undersigned citizens, residents, business owners, and property owners within the municipality of La Paz demand that the La Paz City Council, SEMARNAT, and PROFEPA to take the following actions:

  1. PROFEPA:  Re-open the historic public road serving Playa Agua Caliente that the private developer has blocked;

  2. SEMARNAT:  Approve the application for an acuerdo de destino submitted by the Municipality of La Paz in January 2022 and survey the federal maritime zone;

  3. SEMARNAT:  Assume jurisdiction over and improve the federal lands that lie between the federal maritima zone and the private properties to the west (sometimes referred to as the “terrenos ganados al mar”) to improve the public’s use and enjoyment of the federal maritime zone at Playa Agua Caliente in accordance with Article 27 of the Constitution.*
