Governor Hickenlooper signed HB 16-1320 on Wednesday the 8th.
While this is a bit of a loss it is not the overwhelming disaster the original bill would have been. I want to thank everyone who wrote and supported our efforts to get changes placed in the bill. I think that given the possibilities and the short time that we had to fight it that this can be counted overall as a victory.
Originally HB 16-1320 would have allowed local jurisdictions to enact and enforce regulations on Massage Therapy. This would have been in addition to the current State Licensing. In some jurisdictions massage therapists would have been subject to both local and state licensing and fees.
The original version also made a provision for DORA to label certain Licensed Massage Therapists and their businesses as "Massage Parlors" and subject those licensees and their businesses to additional regulation. What's more this label or designation was to be done wholly at the discretion of DORA. It contained no specific direction or criteria and so could have been used arbitrarily.
The original version also allowed for warrantless search of massage therapists registered business address, which for a large majority is their home.
Due to all of your efforts none of these things came to pass. Thank you, Thank you, Thank you to everyone for your help in getting these important changes made. So while the bill did pass most of the worst of it was taken out before it got to the Governor's desk.
