Make tinted windows legal in California - Our Health & Safety Matters!
The Issue
Currently very few states including California ban the use of any film such as window tint on the front driver and passenger windows as well as the windshield. Their are two trains of thoughts behind this law depending on who you ask. There are some who say it limits visibility and presents a safety risk and others say it presents an Officer safety risk when conducting a traffic stop. Here is my take on it. Many things in life can present a safety risk but they are not illegal. Wearing sunglasses at night may cause you to walk in front of a moving car and be killed but it is not illegal. Neither is driving at night with sunglasses. If you cannot see well at night, do not tint your windows very dark or don't tint them at all. Everyone has a unique situation. We cannot police the masses because of the few. The second point I'd like to make is that tinted windows do not present a risk to Officer safety. I was a municipal Police Officer in 2 of the largest cities in California for 6 years. Not once did I put myself in a dangerous situation because of tinted windows. If you pull a vehicle over and they do not roll their windows down, tinted or not, something is not right and you should not approach the vehicle. That is why they invented a loud speaker in Police vehicles. I support removing the ban on front tinted windows for several reasons I will list below. However, I would like to make a stipulation that upon being legally pulled over by a Police Officer for a lawful offense or lawful detention, you MUST roll down your windows "for Officer Safety." If you fail to do so, you put the Officer at risk and he or she would have every right to call you out of the vehicle during the remainder of the stop. Does anyone see a problem with that stipulation? If you are not a criminal, I don't see why you would. Now, why do I think tinted windows should be illegal. The same reason everyone does. Health and safety. I do not want tint for the "cool factor." Well, cool meaning hip. I do want to "cool" my vehicle down. California is made up of several different climates including many deserts. I can not speak for those who live in the Mojave, Barstow, Baker, Death Valley, etc. but in Fresno the temperatures reach as high as 110 in the summer which can last from April to November. When I enter a vehicle without tinted windows I risk burning myself on my seats, steering wheel, shift knob, just about anything. I also face the risk of heat exhaustion or heat stroke. If you think I am being dramatic, park your car in the sun for 8 hours while at work, get in, and sit there for 3 minutes. See how you feel. In addition to the risks heat presents in a parked car, there is the matter of driving in hot environments. Lets face it, not everyone has air conditioning in their vehicles. There are still old cars on the road. Driving from Fresno to Las Vegas is mostly through desert. You will, no doubt, arrive at your location with severe burns to one or both of your arms from the suns rays penetrating the window. There are many Doctors who would back this claim. The American Cancer Society even endorses specific brands of tint that they say can prevent skin problems such as skin cancer or sunburns. So what is the real reason tint is illegal? It gives Police Officers the probable cause to pull a vehicle over to inspect for further illegal activity. Tint has grown in popularity that you see all kinds of people with it, old, young, rich, poor, movie stars, "Police Officers", everyone. This also brings in revenue to a state that needs all it can get. We must not allow the government to make regulations that restrict our freedoms in the interest of money. Saying that window tint bans prevent crime or accidents is like saying gun bans prevent crime. It doesn't. Those who want tint, will tint, no matter what. Let's not criminalize the hard working people of California because we care for our skin, our pets, our children, our families, and anything else in the vehicle. We can make change.
