Fight For Your Money; Sue The Department of Employment, Training,& Rehabilitation (DETR)
The Issue
The Department of Employment, Training and Rehabilitation (DETR) is actively and wrongfully withholding claimant benefits. DETR’s ongoing failure to comply with its legal and moral obligation have resulted in extraordinary harm to Nevada’s workers. Many having to rely on food banks to feed their children, mortgage and credit card defaults, credit scores ruined, depletion of life and retirement savings, eviction proceedings, and homelessness. All leading to depression, despair, loss of self-worth, domestic violence, a strain on social services, as well as suicidal contemplation.
According to DETR, as of August 19, 2020 there were 243,963 unpaid claims, and the amount of back pay per claim would be closer to $16,000 per claimant. Therefore, it is estimated the full amount of federal relief due but unpaid would be in the range of $4 billion dollars. This is as of 2009; many claimants with "Monetary Determinations" stating their eligibility from the start of the COVID-19 Pandemic have not been paid languishing in various stages of limbo. The level of what I view is incompetent inefficiency by design has been and is extremely profitable for DETR. In my case, I couldn't get my claim into the system until July 31st of 2020, with a claim effective date of April 26th, 2020. After extreme effort I finally spoke with an agent on September 22nd who couldn't tell me why I hadn't been paid, but gave me a list of documents to provide such as bank statements, utility bills, front and back copies of my ID, social security and medical card, as well as a picture of me holding my ID. My claim was still not paid after all of this and remains unpaid to date.
Multiple phone calls to DETR, and contacting elected officials, who also learned the lesson that DETR does what it pleases when they attempted to intervene, also failed to result in payment. It wasn't until I filed a "Petition for Writ of Mandamus" that I actually got some movement on my claim. I have been in a legal battle with DETR since January of 2022. My battle is in the last stage; I am waiting for a decision on my "Petition for Judicial Review". At one stage my Writ Petition was granted but the ruling was reversed, not denied, but reversed when DETR filed for a reconsideration of the ruling granting the petition. The time to act is now! DETR has no reverse gear, their process is much too profitable, and they are not being properly held to account. I hope you will join me in fighting back by first signing this petition and secondly filing legal action (Writ Petition). Let's flood the court with legal action against DETR to shine the light on their grift so eventually they must be dealt with. I recommend you set up an email specifically for the purpose of managing your case. Most people have hundred or thousands of messages in their inboxes. A separate email would serve one purpose and be much easier to manage. I hope you will consider using the email format "yourlastnameDsuit@gmail.com". This will serve the purpose of letting DETR and the court know these legal actions are more than individual filings, they are more of a movement or protest.
