Investigate/Remove Judge Justin Beresky for Alleged Negligence and Misconduct
The Issue
I am compelled to initiate this petition, burdened by personal eyewitness experience of the results of matters presided over by Judge Justin Beresky (appointed by former Governor Ducey), where children's safety and well-being have been egregiously overlooked. It is heartbreaking to reveal that Judge Justin Beresky has repeatedly chosen to position children in an environment of sexual and physical abuse, further, with no-contact orders to communicate fears and danger with the safe parent, a devastating circumstance that is unequivocally unacceptable.
In Maricopa County, AZ, Judge Justin Beresky has demonstrated a dangerous pattern of granting full custody to sexual abusers, blatantly stating 'personal motives' while usurping safe parents' rights to protect their children. He imposes no-contact orders on innocent parents, hindering their ability to monitor their children's well-being. It defies comprehension that an individual, could turn a blind eye to such heinous acts of child endangerment. It is exceedingly clear to see that Judge Justin Beresky cannot act objectively within the rule of law to decide matters fairly in the best interests of the children, instead supporting the best interests of the sexual predator. On that point - the rule of law, it is important to note neither rule nor law are clearly followed in Justin Beresky's orders - orders which have no place in an objective court. For example:
Under § 25-403.03(F), if an Arizona court finds a parent has committed an act of domestic violence, the offending parent has the burden of proving that “parenting time will not endanger the child or significantly impair the child’s emotional development.” If the parent meets this burden to the court’s satisfaction, the court •••SHALL ••• place conditions on parenting time that best protect the child and the other parent from further harm.
Another example:
"The court shall ( ~shall, not may, not might, not could. But Shall. Shall consider~) consider all factors that are relevant to the child's physical and emotional well-being, including:
B. The court •••shall ••• consider evidence of domestic violence as being contrary to the best interests of the child. The court •••shall••• consider the safety and well-being of the child and of the victim of the act of domestic violence to be of primary importance. The court shall consider a perpetrator's history of causing or threatening to cause physical harm to another person.
4. If the child is of suitable age and maturity, the wishes of the child as to legal decision-making and parenting time.
Whether there has been domestic violence or child abuse pursuant to § 25-403.03."
If the sexual abuse victim does find a way, the courage to voice, convey their wishes, they will be silenced by Judge Beresky. The wishes of the child, silenced.
You are encouraged to read ARS § 25-403.03 in its entirety. The law requires many many things of Judges when domestic violence is present.
Apparently anyone, regardless of qualifications, can be appointed to such a critical role. His rulings consistently favor power over the best interests of the child. Every case he has presided over deserves to be thoroughly examined and appealed, and reexamined not at the unjust burden of the already financially- exploited safe parent. His work constitutes a failure to uphold justice and clouds the integrity of Maricopa County Family Court.
According to The National Judicial Conduct and Disability Law Project, Inc., judges are required to "uphold the integrity and independence of the judiciary" and "avoid impropriety and the appearance of impropriety in all their activities." Judge Beresky's actions blatantly flout this fundamental ethical principle, subjecting innocent children to potentially lifelong trauma as solidified by countless studies.
Why is it a good time to act? We can also see evidence of this same conduct with other judges in Maricopa County. Court conduct must be clear instead of increasingly expanding against the rights of victims of sexual abuse.
In fact, investigation of Judges who put their own interests before the welfare of abuse victims will not go far enough. Reform is needed. The ability runs deep and wide allowing judges to condone and support abuses, to even financially subsidize the lives of abusers, and will not be stopped permanently simply by investigation and removal: a new structure, transparency standards and reform is critical.
We urge Governor Hobbs to commission an immediate investigation into Judge Beresky's record and fitness for service on the bench. Stand with us to protect the children of Maricopa County by demanding this much-needed judicial review that prioritizes children's safety and well-being.
