Investigate Judicial Misconduct in the 3M Earplug Litigation

The Issue

More than 300,000 U.S. servicemembers and veterans joined MDL 2885: In re 3M Combat Arms Earplug Litigation, seeking justice for hearing loss and related injuries caused by defective 3M earplugs. Instead of fair trials, plaintiffs were forced into an unjust global settlement in August 2023, under conditions that violated due process and undermined trust in the federal courts. Why We Are Petitioning • Coercion into Settlement: Over 250,000 plaintiffs were pressured to accept the deal. Attorneys were allowed—or encouraged—to withdraw if their clients refused, leaving servicemembers without representation. • Case Management Order 57 (CMO 57): Pro se plaintiffs faced punitive and intimidating requirements or risked dismissal. • Denial of Constitutional Rights: Many were deprived of their right to a jury trial under the Seventh Amendment and due process protections under the Fifth Amendment. • Bias Toward 3M: Court orders and sanctions consistently favored the defendant while harming veterans and active-duty members. What We Demand We call on the United States Court of Appeals for the Eleventh Circuit Judicial Council to: 1. Investigate Judge M. Casey Rodgers’ conduct in overseeing MDL 2885. 2. Review whether her actions amounted to coercion and denial of due process. 3. Take corrective and disciplinary action to restore fairness, accountability, and confidence in the judiciary.
