Investigate Judicial Bias in Kern County Family Court – Demand Fair Custody Rulings for Al

The Issue

My name is Omar Malik. I am a father from Bakersfield, California, fighting not only for custody of my child, but also for fairness, accountability, and due process in Kern County Family Court.

 


On February 10, 2025, Judge Lisa Pacione granted a permanent domestic violence restraining order (DVRO) against me in Case No. BFL-24-002149. This decision was based entirely on testimony from the petitioner, even though her sworn declarations contradicted each other and police records proved her claims were false.

 


The court refused to consider medical evidence proving that I suffer from severe knee degeneration (Grade 4 in the right knee and Grade 3 in the left), which makes it physically impossible for me to have committed the alleged acts of abuse. The judge stated I was “not credible” but made no effort to review my X-rays or medical reports.

 


Even more disturbing, the court admitted into evidence a secretly recorded audio clip that was made without my knowledge or consent—despite California’s two-party consent law. The recording contained no abuse or threats, only a verbal disagreement, and yet it was used to damage my character.

 


When I filed a motion to terminate the restraining order with medical documentation, the hearing was set for June 2, 2025. But during that hearing, Judge Tanya Richard called a recess to consult with Judge Pacione and then attempted to dismiss my motion using a non-existent service defect. This suggests judicial coordination and a disregard for proper procedure. I have filed formal complaints with the California Commission on Judicial Performance.

 


This system is broken. Judges should not be allowed to ignore evidence, accept false testimony, or violate privacy laws to justify rulings that take a child away from a parent.

 • The misconduct and judicial bias in my case

 • The misuse of illegally recorded audio in family court

 • The need for transparency, accountability, and reform in Kern County’s family law system

 


This is not just about me—it’s about every parent who could lose their child because a judge refused to follow the law or review the facts.
