Investigate Judge Beverly Cannone for Judicial Misconduct in the Karen Read Case

We, the undersigned, demand that the Massachusetts Commission on Judicial Conduct immediately investigate Judge Beverly Cannone for her biased rulings and judicial misconduct in the case of Commonwealth v. Karen Read (Docket No. 2282CR00117).

Why This Matters

The American legal system is built on fairness and impartiality. However, Judge Cannone has repeatedly made legally questionable rulings that favor the prosecution, undermining the defendant’s constitutional right to a fair trial.

Her decisions raise serious and grave concerns about judicial bias, fairness, and procedural misconduct, including:

Key Instances of Judicial Misconduct
🔹 Denied the Defense’s Right to Present a Third-Party Culprit Theory – Despite Commonwealth v. Jewett (1984) allowing third-party culpability defenses, Judge Cannone prohibited the defense from introducing this argument in opening statements, prejudicing the jury from the start.

🔹 Allowed an Unqualified Expert Witness for the Prosecution – On March 6, 2025, she ruled that Dr. James Crosby, a non-medical expert, could testify on forensic injury causation, despite not being a licensed medical doctor or forensic pathologist. This violates Massachusetts’ expert witness standards (Commonwealth v. Hinds, 2021).

🔹 Denied a Motion to Dismiss After a Mistrial – On August 23, 2024, she refused to dismiss charges, despite a mistrial where jurors reached a not guilty consensus on two charges, contradicting Commonwealth v. Hebb (2017). This raises double jeopardy concerns under Article 12 of the Massachusetts Declaration of Rights.

🔹 Abruptly Cut Off the Defense During Arguments – On February 18, 2025, she abruptly ended a hearing when the defense sought to challenge expert witness exclusions, violating Commonwealth v. O’Brien (2000), which guarantees both sides a fair opportunity to present arguments.

Why This is a National Issue

This case is not just about Karen Read—it’s about ensuring that every defendant in the U.S. has access to a fair and impartial trial. If biased judges are not held accountable, judicial integrity is at risk for everyone.

What We Demand

We call on the Massachusetts Commission on Judicial Conduct to:
✅ Initiate a formal investigation into Judge Cannone’s conduct.
✅ Review her rulings for bias and failure to follow legal precedent.
✅ Take appropriate action, including recommending her removal from the case.
