Harsch can, in fact, force Verity out of their building and off their property. All they need is a reason... not too difficult to establish a reason for eviction with a commercial lease, really.
I'm sure there's a clause that precludes using the property to violate state and federal law. Sex discrimination is a crime in California -- and, as a tax exempt "charity" they are not allowed to deny "services" based on sex -- and the SCOTUS ruled in 2015 that discrimination based on sexual orientation is a form of sex discrimination.
Boom.
Now, they are NOT forcing Verity out because Harsch is a classy outfit, but they could -- and who knows? Maybe if Verity refuses to leave, they will.
I bet Harsch has more money and better lawyers than Verity will ever have... but that's all just speculation.
Commercial leases are not like residential leases is the point here, and Harsch has a lot of options they aren't mentioning and the KHOU-TV reporter probably never heard of... because there are no requirements to be a journalist.
Harsch could, for example, force Verity to relocate to another unit in their business park -- one that offers bare walls and concrete flooring -- a leaking roof and backed-up plumbing -- but in a "safer" location -- you know, for Verity's safety -- so they don't feel the need to erect illegal barricades and don't need to pay for armed security to hold back the throng of 11 protestors on a Sunday evening.
In California, with a commercial lease, no warranty of habitability is required -- Verity would need to pay out of pocket to "improve" their new location for use. Would need to relocate that hot tub they use for baptisms.
Harsch could demand rent plus 20% -- basically for no reason, other than they can -- although maybe it's to cover the cost of presumed loss of property value resulting from wear and tear from all those legal and welcome protesters trampling all over the place three times a week until March 31, 2017 -- after which date Verity doesn't have a lease.
Harsch could simply establish cause, demand Verity leave, and then serve them with an unlawful detainer (eviction notice, to you and me) -- and then Verity has five days to leave -- really, it's only three, but why rush? Just don't let the door hit you in the ass on the way out...
So, yeah... Harsch is trying not to be harsh, but if they wanted to force Verity off their property? They could.
I admire their approach. They are a commendable group; an asset to the community.
