In this country if you want to drive, insurance is required; however, insurance companies that process claims are currently allowed, by existing laws to avoid telling their claimant's of the statues of limitations, which limit the claimants rights to a fair and equitable settlement. Furthermore, these laws encourage insurance agents to mislead their claims process until said statutes toll, forever forbidding a claimant to be compensated for their injuries. It is also noted that without attorney involvement there is no way a claimant can extend his or her statues, but there is no way they would know that without their rights being conveyed to them. Thus it would be prudent that the insurance company should bear the responsibility, as the informed expert to be required by the DOI laws to disclose a claimant’s rights and responsibilities (i.e., statutes and claims processing procedures and limitations). These laws affect every race, color, creed, and national origin and therefore should be amended to be more equitable to all, not just the insurance companies.
