

My name is Elizabeth Hernandez, I am a nurse practitioner and a mother of five, I am writing to plead for a review of my case. I have been incarcerated for almost 19 months for a crime I did not commit.
I was convicted after a jury trial in which prosecutors presented a false narrative, misleading evidence, and testimony from witnesses who received reduced sentences, full immunity in exchange for a narrative to insure my conviction. Despite their false testimony, every witness admitted under cross examination that they either did not remember me or had never spoken to me.
A year after my conviction, in October 2024, the Department of Health (DOH) completed its own independent investigation. They concluded that I had not violated any laws or committed any crime. Yet, I remain in prison.
Keeping me incarcerated for a crime I did not commit is not only a grave miscarriage of justice it is a cruelty to my children, who continue to suffer due to my absence. I had always believed that the justice system was meant to seek truth and fairness, but my case has proven otherwise. The prosecutors did not seek justice; they sought a conviction at any cost.
During trial, the prosecution’s entire case was based on alleged violations of Medicare rules and regulations, yet in their closing arguments, they admitted I had not violated any Medicare rules. Instead, they focused on the false claim that I had documented an examination for a patient I had never seen. However, the only evidence they presented were fraudulent prescriptions, auto-generated templates created by companies orchestrating the fraud. They did not show the actual medical charts I signed, which did not match the prescriptions.
Three months before my trial, the software company responsible for generating these false prescriptions was indicted for creating fraudulent prescriptions by removing all references to telemedicine from the medical charts of unsuspecting healthcare professionals like me. This information was never disclosed to my defense, which constitutes a significant Brady violation.
I went to trial because I truly believed that the truth would come out and that no jury could convict me for a crime I did not commit. Yet, here I am, separated from my children, living through an unimaginable injustice.
I am reaching out to you because I still believe in justice. I have faith in this new administration and the changes it is bringing. Please help me right the wrongs inflicted upon me and my family. Please review my case and help me return home to my children.
